Terms of Service

These terms are an agreement between you and facebup. facebup is a service of Facebup LLC, a Pennsylvania public benefit limited liability company (“we,” “us,” or “the Company”). “facebup” or “the service” means the facebup.com website and app. By creating an account or using facebup, you agree to these terms. If you don’t agree, don’t use facebup.

facebup is an owner-controlled vault for your pet’s records. We wrote these terms to be read, not skipped. Where the law lets us, we’ve kept them plain. Read the Privacy Policy too — it explains how we handle your data, and it’s part of this agreement.

1. Our core promise: your records are never sold

We will never sell your pet’s records, and we’ll never share them without your say-so.

To say it in full: we will never sell your pet’s records — not to advertisers, not to data brokers, not to “partners,” not anonymized, not ever. Never selling is a one-way door: it’s a binding term of this agreement, and we can’t quietly walk it back. We built facebup as a Pennsylvania public benefit company so this commitment is part of our legal purpose, not just a policy we could drop later.

By default we also don’t share your records with anyone outside facebup for their own purposes. From time to time we may offer optional programs or campaigns — for example a research study, or a perk from a partner — that only work if you choose to share certain records. These are strictly opt-in: before anything is shared, we’ll show you exactly what would be shared, with whom, and why, and nothing leaves facebup unless you say yes. You can decline, and you can withdraw a previous opt-in at any time. No opt-in, no sharing.

Separately, the service providers we use to run facebup itself (for example, our hosting and storage) process your data only to operate facebup, only under our instructions, and never for their own purposes. That is not selling or sharing. We name every one of them in our Privacy Policy.

2. Who can use facebup

facebup is for adults. You must be at least 18 years old to create an account, and by signing up you confirm that you are 18 or older. facebup is not directed to children, and we don’t knowingly collect information from anyone under 18.

3. Your data is yours

The records, documents, and photos you put into facebup belong to you. We store them and organize them so you can use them — we don’t claim ownership of them.

You can export everything, anytime, free, forever. Your export includes your records as structured JSON plus the original documents you uploaded. There is no fee and no premium tier for getting your data out. You grant us only the limited permission we need to store, process, display, and back up your content so we can provide the service to you and the household members you invite.

4. Deleting your account

You can delete your account at any time from within facebup. When you request deletion:

Once the purge completes, your data is gone and cannot be recovered. For legal and security reasons we keep a minimal, non-identifying audit record that the account was deleted, but not your pet’s records.

5. Document ingest and AI extraction (no medical advice)

When you upload a document, facebup can read it and fill in record fields for you ✨. This is a convenience to save you typing. It is informational only — always verify the extracted details against the original and with your veterinarian.

facebup does not provide veterinary, medical, or professional advice, and nothing in the service is a substitute for a licensed veterinarian. The original source document you upload is always preserved and is never overwritten or altered by the extraction — it remains the source of truth, and you review and confirm extracted fields before they’re saved.

6. A free basic service, premium seats, and affiliate links

There will always be a free facebup. Your records vault — storing, organizing, exporting, and deleting your pet’s records — is free for everyone, with no paywall and no trial clock on the basics. We’re committed to keeping the core service that holds your pet’s history free.

We do plan to offer premium features on top of the free vault, available through paid “seats.” A seat can be paid for by you, or sponsored on your behalf by a provider you work with — a vet, boarding or grooming service, and the like. Premium features are extras; they never put your existing records behind a paywall.

Because your vault is always free, your records survive the gaps. If a provider-sponsored seat ends, or you switch from a sponsored seat to paying your own way — or stop paying for premium entirely — your records stay yours and stay accessible. You never lose your trail.

facebup may also include affiliate links — for example to pet insurance or supplies (such as Pumpkin, Chewy, or PetMeds). If you follow one of those links and buy something, we may earn a commission at no extra cost to you. We disclose this so you know when a link is an affiliate link. Affiliate relationships never involve your records, and they never change the promise in Section 1.

7. Acceptable use

When you use facebup, you agree not to:

We may suspend or terminate accounts that violate these rules (see Section 12).

8. Account security

facebup signs you in with a one-time magic link sent to your email — there’s no password to create or remember, and each link is single-use and expires shortly after we send it. That means your email inbox is the key to your account, so keep it secure and don’t forward your sign-in links to anyone. You’re responsible for activity under your account. Tell us at support@facebup.com if you think someone else has gained access to your account or your email.

9. Household sharing

You can invite household members to view the pet records you share with them. When you invite someone, they can see those shared records, so invite only people you trust. You’re responsible for who you invite and for what they can see. You can remove a member at any time, and their access ends immediately.

10. The service is provided “as is”

We work hard to keep facebup reliable, accurate, and available, but we can’t promise it will be perfect, uninterrupted, or error-free. To the fullest extent allowed by law, facebup is provided “as is” and “as available,” without warranties of any kind, whether express or implied — including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. You are responsible for keeping your own copies of records that matter to you; that’s exactly why export is always free.

11. Limitation of liability

To the fullest extent permitted by law, the Company will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising out of or relating to your use of (or inability to use) facebup. To the fullest extent permitted by law, the Company’s total liability for any claim relating to facebup will not exceed the amount you paid us, if any, for the service in the twelve months before the event giving rise to the claim.

Some places don’t allow certain limitations, so some of the above may not apply to you. Nothing in these terms limits liability that can’t be limited by law.

12. Termination

You can stop using facebup and delete your account at any time (Section 4). We may suspend or end your access if you break these terms, if we’re required to by law, or if we discontinue the service. If we end the service, we’ll give you reasonable notice and time to export your records first, wherever we can.

13. Disputes

If you have a problem, email us first at support@facebup.com — most issues can be sorted out informally, and we ask you to try that before any formal step. If a dispute can’t be resolved, it’s governed by Section 15 below. You always keep the right to bring an individual claim in small-claims court where you’re eligible, and nothing here waives any consumer right you can’t waive under your local law.

14. Changes to these terms

We may update these terms from time to time. When we do, we’ll change the “Last updated” date at the top. For material changes, we’ll give you reasonable advance notice — by email to the address on your account and/or a clear notice in the app — before they take effect. If you keep using facebup after a change takes effect, you’re agreeing to the updated terms. If you don’t agree, you can export your data and delete your account.

15. Governing law

These terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to its conflict-of-laws rules. Any dispute that isn’t resolved informally will be brought in the state or federal courts located in the Commonwealth of Pennsylvania, and you and the Company consent to the jurisdiction of those courts — except where your local consumer law gives you the right to sue, or be sued, somewhere else.
